Diversion 

1.  Is any child eligible for the Diversion Program if child is a first time offender with a misdemeanor complaint?

Answer:  Yes.

2.  Can a child be eligible for the Diversion Program if child is a first time offender with more than one (1) misdemeanor complaint?

Answer:  Yes, provided child admits to all complaints.

3.  What happens if parent/guardian cannot make arrangements for child to participate in the Diversion Program?

Answer:  Complaint will be forwarded to the formal court.

4 What if child completes the Diversion Program successfully, and receives another misdemeanor complaint for the same offense, or similarly related?

Answer:  Child would be ineligible for the Diversion Program, and complaint would be handled in formal court.

5.  Will my child’s involvement in the Diversion Program remain confidential?

Answer:  Your child’s involvement in the Diversion Program will remain confidential with the exception of an act that constitutes a violation of a school rule or student code of conduct.  The school superintendent may inquire about the matter to the Court and the Court will advise the superintendent that this case was brought to the Court’s attention.

6.  Once my child completes the Diversion Program, will the military/employer have access to information child was informally involved with Juvenile Court?

Answer:  No, child will appear as having no history with court.

7.  What is the age range of those youth involved in the Diversion Program?

Answer:  8 through 17.

8.  Does each child entering the Diversion Program have the same Diversion Contract?

Answer:  no, each contract is designed to address individual issues.

9.  Does my child need an attorney at the Diversion Hearing?

Answer:  No, but you may have an attorney attend the hearing or consult an attorney prior to the hearing.

Diversion Prevention Program

1.  Is Diversion Prevention and Diversion the same?  

Answer:  No.  Diversion Prevention is based upon a referral process.  Diversion is based upon an official complaint received by the court.

2.  Are Diversion Prevention youth court involved?

Answer:  No.  Youth involved in Diversion Prevention do not have a court record.

3 What are the ages of youth involved in Diversion Prevention?

Answer:  Children beginning at the age of 6 may be eligible for the Diversion Prevention Program.

4. Who can be involved in Diversion Prevention?

Answer:  Children beginning at the age of 6, who have not had any previous court involvement, may be eligible for the Diversion Prevention Program.

5.  Who can make referrals to the Diversion Prevention Program?

Answer:  Parent/Guardians/ Law Enforcement Officials: School Representatives; Children Service’s Board.

Mentorship Program

1.  Where do mentoring activities take place?

Answer:  Mentoring activities are made between the mentor and the mentee.  They may be as creative as they wish in planning activities.

2.  Will parents/guardians need to provide transportation for mentoring activities?

Answer:  Seeing that transportation is a problem for some of our families, we do encourage mentors to provide as much transportation as possible.

Strengthening Families Program 

1.  What is the cost for this program?

Answer:  Thanks to the support from the community, this program is FREE for your family to attend.

2. What times does the program run?

Answer:  The program is run in the evening.  The time is normally 5:45 P.M. to 8:00 P.M.

3.  What night is the program on?

Answer:  Depending on the area of the county in which you live depends on the night you will attend.  However, the program is run on Monday and Tuesday nights.

4.  Where is the program located?

Answer:  The program is located in Fairborn and Xenia at rotating sites.

5.  How old do your kids have to be?

Answer:  For SFP 1, the kids are between the ages of  5-10.  For the SFP II, the youth are between the ages of 10-14.

6.  Do you have to be involved with the court system to attend the program?

Answer:  No, this program is available to all families of Greene County.  In fact, we really enjoy working with a variety of families that are self-referred , as well as court referred.

7.  Do you have daycare for the younger children?

Answer:  Unfortunately, we do not provide daycare for the younger siblings.

8.  How do I sign up?

Answer:  You simply call Emily at (937) 562-4049 and she will get you registered.

Teen Court

1.  Are parents required to attend every Teen Court session with their child?

Answer:  No.  Parents are required to attend the Teen Court hearing when their child is the Defendant.  They are then responsible for making sure child attends all scheduled groups and Teen Court sessions.

2.  Is the person on the bench a Judge?

Answer:  No.  We have two (2) University of Dayton law students who guide the Teen Court participants to make sure proper procedure is being followed.

3.  What length of time is Teen Court?

Answer:  Each child attends four (4) consecutive weeks as a member of Teen Court.  Actual time to complete all required dispositions varies, depending on other groups and/or programs to which the child is referred.

4.  Is Teen Court offered on any other day? 

Answer:  No. Teen Court is only on Wednesday evening, from 6:00-8:30 P.M.

5.  What if my child does not admit to the charge filed?

Answer:  The case will be set for a formal court  hearing at a date and time to be determined. 

6.  Can my child admit the charge just to “get it over with”?

Answer:  No.  Our Program is developed for those who accept responsibility for their involvement that led to the charge.  Our Program is not to be an “easy way out”.
