Citizens in the midst of a high conflict
child custody dispute can benefit from this service. A
home investigation is initiated by a Court Order from a Judge or
Magistrate.
Your attorney can file a motion
petitioning the court to order this service.
The process begins with each party completing
a detailed questionnaire. An investigator in our office reviews the
questionnaire and conducts face-to-face interviews with all parties, the
children at issue, and any collateral sources deemed necessary (teachers,
neighbors, doctors, etc.). Relevant criminal, medical, and psychological
records are collected via court order. All information gathered by
the investigator is reviewed and summarized into a 10-15 page report.
The report is provided to both attorneys and to the Court with a recommendation
regarding the children's best interests. Investigators are available
to provide testimony, and are subject to cross-examination by attorneys.
Each investigation takes at least 90 days
to be completed from the date it is ordered by the Domestic Relations or
Juvenile Court. The cost is determined by the court and may be split between the
parties or incurred exclusively by one party.
In certain cases, the court may waive the cost
entirely.
