Transfer on Death Recordings
Transfer on Death Beneficiary Designation Affidavit
To establish transfer on death interests, a designation affidavit must be recorded prior to the death of the property owner.

TOD Beneficiary Designation Affidavits must include:
  • A current, complete, and correct property description with plat cabinet and page and parcel number(s) checked and approved by the Engineer’s Tax Map Department
  • Prior deed reference
  • Notarized signature(s)
  • TOD beneficiary affidavits are not transferred in the auditor’s office prior to recording
  • Correct recording fees and a self-addressed stamped envelope. Modifications, revocations, amendments, releases, and  recordings of the affidavit will be charged a notation fee

Transfer on Death Affidavit of Confirmation
A TOD Affidavit of Confirmation transfers the interest in the property to the designated beneficiaries after the death of the owner.

TOD Affidavits of Confirmation must include:
  • A notice of pending transfer of property by transfer on death deed , aka Medicaid Estate Recovery Form, along with a copy of the TOD designation affidavit or the TOD deed that was recorded prior to the death of the property owner
  • A certified copy of the property owner’s death certificate
  • Prior deed reference
  • Volume and page of recorded transfer on death beneficiary affidavit
  • Notarized signature(s)
  • A current, complete, and correct property description with plat cabinet and page and parcel number(s) checked and approved by the Engineers Tax Map Department
  • Must be transferred in the Auditor’s Office before recording. Please contact the Greene County Auditor’s Office for information regarding transfer requirements
  • Correct recording fees and a self-addressed stamped envelope
