The official listing of upcoming properties to be sold can be found in the Tuesday edition of the Xenia Gazette and Fairborn Daily Herald for three consecutive Tuesday’s prior to the date of sale. Current and past foreclosures are available using our online application, however the information provided is a courtesy and should be verified for accuracy by the official ad. The status of a sale can be changed at any time right up to the time of the sale.
The Sheriff’s Office nor any affiliates have access to the inside of the properties including appraisals for bank loans. Buyer beware the property is bought “as is” without any warranties or guarantees. It is the responsibility of the buyer to check the property for back taxes, delinquent utility bills, liens, and /or any additional cost associated with the property. Taxes & Assessments
All taxes and assessments that are filed with the Greene County Treasurer will be deducted from the proceeds of the sale. This includes delinquent real estate taxes and pro-rated taxes through the month of the Confirmation of Sale being filed with the Clerk of Court. The successful bidder will be responsible for any subsequent taxes or assessments after that date.
Remote Bids – Lienholders only
Remote bidding is strictly limited to lien holders only. If you are not notified as an interested party in the case, you will not be permitted to submit a remote bid.
The Remote Bid Form and the Purchase Information Form will need to be submitted to the Greene County Sheriff’s Office by the following:
- Fax: (937) 562-4867 – must be received by 4:30 p.m. on the day preceding the sale date.
- Email: gcsheriffbids – must be received by 4:30 p.m. on the day preceding the sale date.
- Overnight delivery or courier. The sheriff’s office closes at 4 p.m.
To all who submit remote bids, the results of the sales will be posted on the Greene County Sheriff’s Office website by the close of the business day on the date of sale.
Greene County Sheriff’s Office does not take responsibility for not receiving Remote Bid Forms and Purchase Information Forms due to mechanical, electronic or technology issues.
Bidding – 2329.20
The starting bids will be two-thirds of the appraised amount unless otherwise noted. The appraisal is a “drive by” appraisal. The appraisers assume no responsibility for, and give no weight to, unknown legal matters, including but not limited to, concealed or latent defects, and/or the presence of harmful or said chemicals, pollutants, or gases. You must be present in order to place a bid.
Second Sale Date – 2329.52
When a residential property is not sold (no bids) on the first sale date, then a second sale date will be held two weeks after the first date at the same time and location. There will not be a set minimum bid; the property is sold to the highest bidder. If the bid does not cover all costs determined by the court the purchaser must also pay the amount sufficient to pay the cost, allowance and taxes that the proceeds of the sale are insufficient to cover. (2329.21)
Redemption – 2329.311
In the sale of a property that was sold with no set minimum bid the judgment creditor and the first lienholder each have the right to redeem the property within fourteen days after the sale by paying the purchase price.
Third Party Purchaser – 2329.211
The successful bidder must submit a photo id immediately after winning the bid. All third party purchasers of a residential property will be required to deposit a down payment at the conclusion of the sale by personal check with a completed Purchase Information Form. The sale deposit is as follows:
- If the appraised value of the property is less than or equal to $10,000.00 the deposit is $2,000.00.
- If the appraised value of the property is greater than $10,000.00 but less than or equal to $200,000.00 the deposit shall be $5,000.00
- If the appraised value of the property is greater than $200,000.00 the deposit shall be $10,000.00
Judgment Creditor and Lienholders Purchaser
The Judgment creditor and lienholder will no longer be required to make a deposit at the time of the sale. A Purchase Information Form must be submitted at the end of the sale.
- 30 calendar days from the sale date, an Entry Confirming the Sale must be filed with the Clerk’s Office – 2329.31A
- 7 calendar days from the filing of the Confirmation, the attorney is to submit the deed to the Sheriff’s Office – 2329.36
- 30 calendar days from filing the Confirmation, payment in full must be received by the Sheriff – 2329.31B
- 14 days from Sheriff receiving Correct Deed and Confirmation of sale the Sheriff must record the deed with the County recorder – 2329.36C
Balance of Purchase Price 2329.31
The balance of the purchase price is due 30 calendar days from the filing of the Confirmation. The conveyance and recording fees will also be due at this time. The balance must be paid with a cashier or certified check made payable to “The Greene County Sheriff’s Office”. Failing to provide the balance due within those 30 days, you are at risk of forfeiting the down payment.
Writ of Possession
If the property is occupied, you may need to file for a Writ of Possession through the Clerk of Courts once the deed has been transferred and recorded in your name. If you have questions in regards to filing with the Court, please consult an attorney.
